RESUMENEste trabajo analizará cuáles son las posibles consecuencias que los descubrimientos de la neurociencia pueden tener sobre la reflexión ética en torno al deporte. Siguiendo los trabajos en neuroética de Jonathan Haidt y Joshua Greene, parece ser que nuestro comportamiento moral está basado en una serie de mecanismos automáticos neuronales de carácter emotivo que acontecen en nuestros cerebros. Estos mecanismos podrían ser útiles a la hora de explicar el comportamiento de los hinchas deportivos, sin embargo, convertirían en inútiles los esfuerzos (...) de la ética del deporte por establecer el principio del fair play como regulador ético de la práctica deportiva. Este trabajo ofrecerá dos contra-argumentos que mostrarán que, primero, nuestro comportamiento no está determinado por ciertos mecanismos automáticos que acontecen en el cerebro y, segundo, de hecho, la configuración de nuestro cerebro facilitaría en ciertos casos la posibilidad de que los hinchas desarrollen un comportamiento más ético. Given Jonathan Haidt’s and Joshua Greene’s works on neuroethics, our moral behaviour seems to be mainly rooted in emotive mechanisms within our brain. If this is true, then sports supporters’ behaviour can easily be explained by appealing to such emotive brain mechanisms. However, they will turn the efforts to apply the moral principle that is supposed to regulate the sporting world—the fair play principle—into useless efforts. I shall give two counter-arguments that will show, firstly, that supporters’ misbehaviour cannot be totally explained by pointing out to several neural—natural—mechanisms, and, secondly, that our brains’ make-up can, nevertheless, make sports supporters more willing to abide by the fair play principle. In this article, I revise the normative account of sport that I proposed in ‘William J. Morgan’s “conventionalist internalism” approach. Furthering internalism? A critical hermeneutical response.’ I first present Habermas’ discursive ethics, placing emphasis on his interpretation of the relationship between moral (Kantian) and ethical (Hegelian/hermeneutical) principles. Then, I provide a reformulation of my account by both drawing on Habermas and going beyond him—as I go beyond Habermas, I will refer to the account as ‘discourse-ethics based.’ To further explore the (...) normative potential of the account, I connect its main tenets to the three main normative theories of sport (formalism, broad internalism, and deep conventionalism) and illustrate it with examples from anti-doping governance. This book examines influential conceptions of sport and then analyses the interplay of challenging borderline cases with the standard definitions of sport. It is meant to inspire more thought and debate on just what sport is, how it relates to other activities and human endeavors, and what we can learn about ourselves by studying sport.

Several authors, such as William J. Morgan, John S. Russell and R. Scott Kretchmar, have claimed that the limits between the diverse normative theories of sport need to be revisited. Most of these works are philosophically grounded in Anglo-American philosophical approaches. For instance, William J. Morgan’s proposal is mainly based on Richard Rorty’s philosophy. But he also discusses with some European philosophers like Jürgen Habermas. However, Habermas’ central ideas are rejected by Morgan. The purpose of this paper is to analyse (...) Morgan’s rejection of Habermas’ thought and show that a more appropriate normative of sport that explains better our current sporting world can be achieved by drawing on the German philosopher’s ideas. The plan of this paper is the following. It shall analyse the limits of the distinction between broad internalism and externalism by taking Morgan’s work as its starting point. Bernard Suits’ groundbreaking work, The Grasshopper: Games, Life, and Utopia, has profoundly shaped the philosophy of sport. Its sequel, Return of the Grasshopper: Games, Leisure, and the Good Life in the Third Millennium, released in October 2022, enriches scholarly understandings of Suits’ views on games, emphasizing the normative aspects of gameplay and its impact on people’s pursuit of the good life. In this book symposium, world-leading Suits scholars analyze the Suitsian conception of gameplay and its relevance to his views on (...) Utopia outlined in the sequel, covering a wide range of topics. Filip Kobiela explores counterfactual situations in Suits’ oeuvre. Christopher Bartel and Gwen Bradford scrutinize the ethical nature and ramifications of Suits’ claim that life is an unconscious game. R. Scott Kretchmar and John S. Russell present thoughtful critiques of Suits’ musing on Utopia. William J. Morgan’s contribution integrates contemporary work studies to illuminate Suits’ utopia. The main goal of this paper is to argue that Anglo-American philosophy and Continental philosophy should work together within the arena of the philosophy of sport. To do so, the concept “communicative community”, which is found in Habermas’ and Apel’s discursive ethics, will be analyzed and applied to sports. As several authors, such as Raúl Sebastian Solanes, Robert L. Simon and William J. Morgan, have done this task before, I will critically analyze their proposals. Ao final da Segunda Guerra Mundial, no contexto marcado pelas apreensões relativas às rivalidades globais entre os EUA e a URSS, Kennan recomendou uma estratégia com a intenção de conter as potenciais tendências expansionistas da União Soviética. Em sua consideração, a principal ameaça posta pela União Soviética não era militar, mas sua capacidade de influência ideológica, (...) veiculada pelos partidos comunistas e seus seguidores no interior das sociedades democráticas ocidentais. By the end of World War II, amidst apprehensions concerning the U.S. and the USSR global rivalries, Kennan recommended a strategy intending to contain the potential expansionist tendencies of the Soviet Union. In his consideration, the core threat upraised by Soviet Union was not military, but its ideological influence conveyed by Communist parties and fellow travelers inside the western democratic societies. From this preceding hypothesis, Kennan designed the doctrine of containment, a crucial strategy of U.S. foreign policy during the Cold War. As a career diplomat and major authority on Soviet society, Kennan wrote during his lifetime an remarkable work related to U.S. diplomacy and its colossal challenges in the environment of that global conflict. Nonetheless, since the inauguration of the second Truman administration, Kennan observed that U.S. Cold War strategy had become more militaristic and that it had strengthened the arms race. For assuming a critical position towards this path, which, according to his perspective, was a distortion of his original containment theory, Kennan was marginalized by the new Secretary of State, Dean Acheson, and displaced from core government power. Subsequently, he stood up against the adoption of the Truman Doctrine, the creation of NATO and the commitment of the United States in the Korean and Vietnam wars. I argue that several recent criticisms Lopez Frias has made against my conventionalist version of broad internalism fail to hit their mark. I further argue that the author's use of Habermas's account of discourse ethics to make his criticisms also misfires because Habermas expressly warned against using his account to resolve normative conflicts that arise from the often conflicting ways different communities order their ethical lives, to include their athletic lives. My main aim in responding to Lopez Frias was to (...) bring critical attention to the normative difficulties that result when we cannot agree on how sport should be done because we cannot agree on what is/are the purpose of sport. Information can be public among a group. Whether or not information is public matters, for example, for accounts of interdependent rational choice, of communication, and of joint intention. A standard analysis of public information identifies it with (some variant of) common belief. The latter notion is stipulatively defined as an infinite conjunction: for p to be commonly believed is for it to believed by all members of a group, for all members to believe that all members believe it, and so (...) forth. This analysis is often presupposed without much argument in philosophy. Theoretical entrenchment or intuitions about cases might give some traction on the question, but give little insight about why the identification holds, if it does. The strategy of this paper is to characterize a practical-normative role for information being public, and show that the only things that play that role are (variants of) common belief as stipulatively characterized. In more detail: a functional role for “taking a proposition for granted” in non-isolated decision making is characterized. I then present some minimal conditions under which such an attitude is correctly held. The key assumption links this attitude to beliefs about what is public. From minimal a priori principles, we can argue that a proposition being public among a group entails common commitment to believe among that group. Later sections explore partial converses to this result, the factivity of publicity and publicity from the perspective of outsiders to the group, and objections to the aprioricity of the result deriving from a posteriori existential presuppositions. Uno de los debates más recientes referentes a la innovación tecnológica entre los especialistas en ética es aquel sobre la mejora humana, el cual ha surgido a raíz de la posibilidad de modificar los límites de la naturaleza humana usando el poder de la ciencia. Muchos filósofos nos han avisado del peligro de modificar técnicamente nuestra naturaleza humana. Otros, por contra, defienden que no existe diferencia moral relevante alguna entre las nuevas técnicas biomédicas de mejora y las tecnologías aceptadas como (...) habituales por los seres humanos. Este artículo pretende examinar críticamente tal argumento. El fin de este análisis crítico será doble, primero, mostrar que los autores que defienden esta posición poseen visiones sesgadas y prejuiciosas de la realidad y, segundo, que es necesario establecer una definición más precisa y acotada del término “mejora”. ABSTRACTIn this article, I will identify two key normative principles at the core of Robert L. Simon’s mutualist theory of sport, namely, the respect-for-the-opponent principle and the idea that sport is a practice aimed at pursuing excellence. The former is a Kantian principle grounded in human beings’ rationality, and the latter is an Aristotelian principle related to the development of excellences as a means to human flourishing. After having presented and analyzed both principles, I will critically evaluate Simon’s attempt to (...) combine them within his mutualist approach. In this paper, I engage the debate on Suits’ theory of games by providing a Kantian view of Utopia. I argue that although the Kantian aspects of Suits’ approach are often overlooked in comparison to its Socratic-Platonic aspects, Kant’s ideas play a fundamental role in Suits’ proposal. In particular, Kant’s concept of ‘regulative idea’ is the basis of Suits’ Utopia. I regard Utopia as Suits’ regulative idea on game playing. In doing so, I take Utopia to play a double role (...) in Suits’ theory of games. First, it highlights the primary condition of possibility of game-playing, namely, the lusory attitude. Second, it provides a normative criterion that serves as a critical principle to evaluate instances of game playing and as a counterfactual assumption that makes game playing possible. I provide further support for my Kantian interpretation of Suits’ Utopia by bringing to light the anthropological assumptions upon which Utopia is built. In doing so, I argue that both Suits’ theory of games, in general, and his Utopia, in particular, lay out the conditions of possibility of game playing, not an analysis on the life most worth living. Given current studies in moral psychology and following recent cases of wrong behaviour occurred in elite sporting events ? e.g. the racist chants scandals in the English Premier League or the events following Mourinho's poke in the eye scandal ? I shall analyse the extent to which supporters' brain make-up is determining them to behave in an ?unfair way?. Yet this paper is not just a work on descriptive ethics, but a normative ethics work. Therefore, once I have developed the (...) ?psycho-biological account of sports supporters?, I shall explore whether or not a more virtuous account of sports supporting can be drawn. In order to fulfil this normative task I shall appeal to the concept of ?fair play?. The common view of fair play defines it as ?the act of abiding by the rules?. However, my account of fair play is more complex and it is based on the moral principle of respecting others. This is the reason why fair play is not just something related to athletes but to supporters as well. To conclude, I shall sketch the boundaries of fair-play-based supporting behaviour in order to propose some policies or strategies that can help us to promote a ?healthy? and virtuous behaviour among fans. In this paper, we explore the issue of the elimination of sports, or elements of sports, that present a high risk of brain injury. In particular, we critically examine two elements of Angelo Corlett’s and Pam Sailors’ arguments for the prohibition of football and Nicholas Dixon’s claim for the reformation of boxing to eliminate blows to the head based on the empirical assumption of an essential or causal connection between brain injuries incurred in football and the development of a degenerative (...) brain disease known as chronic traumatic encephalopathy ; and John Stuart Mill’s rejection of consensual domination. We present four arguments to contest the validity of Corlett, Dixon’s and Sailor’s positions. Specifically, we argue that certain autonomy-based arguments undermine paternalist arguments for reform; the nature of the goods people pursue in their lives might justify their foregoing future autonomy; Mill’s argument against consensual domination draws on ambiguous and arbitrary distinctions; the lack of consensus and empirical evidence regarding CTE arising from brain injuries in sport underdetermines calls for reform. We conclude that these proposals for reforming or eliminating sports with high risks of brain injuries are not well founded. (shrink)

In this article, we examine scholarly analyses of justice and develop a framework that can help assess the claims from the parties in the Russian state-led doping scandal, including, but not limited to, Russian athletes, non-Russian athletes, the World Anti-Doping Agency, and sport governing bodies. The two key components of this justice framework are pluralism and relationality/contextuality. We argue that a justice framework built upon these elements better captures the nature of justice. We conclude that no party in the Russian (...) state-led doping case has exclusive access to justice. Rather, all the parties have legitimate calls for justice against one another. Thus, the administration of justice will fail to serve justice, in its different meanings, for all parties. (shrink)

Organized youth sport has become a prominent activity in Western societies, one around which myriad families structure their daily lives. Despite its popularity, or rather because of it, youth sport is besotted with complex problems. One distinctive set of problems pertains to children’s opportunities to benefit from engagement in sport. Such problems require a reflection on the conditions of justice. The goal of this paper is to explore ethical guidelines to make youth sport more just. The paper begins by characterizing (...) childhood, youth, and youth sport. Then, it articulates considerations of justice in youth sport. Together, these sections provide a basis to formulate the general features of a just youth sport. What emerges is a vision of youth sport that the adults involved in it should emphasize and implement if their young charges, and youth sport, are to flourish, as well as a novel approach to formulating and justifying normative criteria to make youth sport more just. Since Sigmund Freud developed and popularized psychoanalysis, this psychological theory has significantly influenced contemporary thinking, particularly in philosophical disciplines focused on understanding human behavior and addressing social problems. Take the examples of political philosophy, race theory, and feminist thought, among many others. However, although sport philosophy qualifies as one such discipline, scholars in this field have given little to no attention to psychoanalysis and psychoanalytical theorists. Remarkably, psychoanalytical notions, especially those of Eric Berne and Norman O. Brown, significantly shaped Bernard (...) Suits’ pioneering thoughts on games. Nevertheless, sport philosophers have largely overlooked the importance of psychoanalysis in Suits’ examinations of games and, more broadly speaking, rarely attempted to apply psychoanalytical concepts to their analyses of sport. In this paper, I explain the psychoanalytical roots of Suits’ theory of games and explore how much of his theory of games is indebted to psychoanalysis. Specifically, I first compare Suits’ analysis of unconscious gameplay to psychoanalytic concepts of repression and neurosis. Subsequently, I explore the alignment between Suits’ views on gameplay and psychoanalytic accounts of play and pleasure. To conclude, I examine the therapeutic and emancipatory character of Suits’ proposal, drawing parallels between his philosophical corpus and critical theorists whose critical analyses of modern society are heavily indebted to Freud. This paper addresses the possibility of robots engaging in sports. Recently, several movies like Ex-Machina, Chappi, and Transcendence challenge the spectator to think of the consequences of creating artificial intelligences. Although we refer to athletes who have outstanding sporting performances as machines, for example, in cycling people say ‘the cyclist looked like a machine with wheels,’ the potential participation of such AI in sport has not been addressed. For our argument’s sake, we will assume that the creation of human-like robots (...) who will mirror human athletes’ behavior in the playing field will be possible. Recent advances in cybernetics and robotics point in this way. As argued in the literature on philosophy of mind, the fact that intelligent robots seem to be doing something does not imply they are actually doing it. UEFA’s Financial Fair Play (FFP) regulations represent the most restrictive regulatory intervention European club football has ever seen. Put simply, it demands from clubs to operate on the basis of their own football-related incomes. While the policy has attracted considerable attention from the economic and social sciences, very few contributions systematically investigate it from a philosophical-ethical perspective. The present paper fills this research gap by posing questions on FFP in relation to fair play as a normative concept. We draw on (...) sport economic assessments concerning potential outcomes of FFP and argue that the policy should go beyond the mere pragmatic goal of promoting financial sustainability and truly aim for creating a level playing field, otherwise it should not be labeled ‘fair play’. La finalidad de este artículo es triple. Primero, las secciones 1 y 2 expondrán la estructura del argumento de Jürgen Habermas respecto a las tecnologías de mejora humana. Para ello, éste será descompuesto en tres partes, que son sus pilares básicos: a) los sujetos diseñados no pueden auto-concebirse a sí mismos como autores únicos de sus vidas; b) la distinción kantiana entre objetos y personas se desvanece como consecuencia del modo en que los sujetos modificados experiencian su cuerpo; c) la (...) relación entre los padres y su descendencia se vuelve asimétrica, de modo que es contraria a las normas de la acción comunicativa. Segundo, en la sección 3, que es concebida como un diálogo entre Habermas y sus críticos, se presentarán algunas objeciones teóricas a su argumento. Tercero, la sección 4 analizará la validez de los argumentos habermasianos y afirmará firmemente que la posición de Habermas arroja luz sobre el modo correcto de analizar las tecnologías de mejora humana desde un punto de vista moral. A saber, en función de la influencia que tienen sobre el modo en que los sujetos se auto-conciben como seres autónomos y responsables.The aim of this paper is threefold. First, the structure of Jürgen Habermas’ argument on human enhancement technologies shall be exposed in sections 1 and 2. In order to do so, this paper shall discompose Habermas’ argument in the following three parts, which will be taken to be its central pillars: a) designed people cannot self-conceive themselves as the sole authors of their lives; b) the Kantian distinction between objects and persons falls apart due to the way in which modified people experience their bodies; c) the relationship between parents and their modified offspring turns into an asymmetric one, so it is contrary to the rules of communicative action. We argue that an unqualified use of the term solidarity in public health is not only equivocal but problematic toward the ends of public health. The term may be deployed normatively by public health advocates to strengthen the bonds among public health practitioners and refer to an ideal society in which the importance of interdependence among members ought to be acknowledged throughout the polity. We propose an important distinction between partisan solidarity and societal solidarity. Because any moralized belief in a (...) vision of a broad societal solidarity will be a contested political ideal, political reality would limit solidarity based on such a vision to partisan solidarity. An idealized vision of societal solidarity is simply not politically feasible in pluralistic, liberal, democratic societies. However, although societal solidarity is unlikely with respect to any particular policy, it might be hoped for with respect to constitutional procedures that provide boundaries for the agon of the political process. We suggest that moralizing assertions of a solidaristic ideal in a pluralistic society might be counterproductive to generating the political support necessary for public health per se and establishing legitimate public health policy. A pragmatic political approach would be for public health advocates to generate sufficient strong political support for those public health policies that are most amenable to the political and social realities of a time and place. The ethics of using genetic engineering to enhance athletic performance has been a recurring topic in the sport philosophy and bioethics literature. In this article, we analyze the ethics of cloning horses for polo competition. In doing so, we critically examine the arguments most commonly advanced to justify this practice. In the process, we raise concerns about cloning horses for polo competition, centering on normative aspects pertaining to sport ethics usually neglected by defenders of cloning. In particular, we focus on (...) how this practice could have a detrimental impact on the central skills of polo, and how it unjustly creates an uneven playing field.
